A jury took less than a hour to find Roger Earl McMurtrey, 32, guilty of first-degree murder in the death of Frances McMurtrey, 60, on Oct. 9, 1995. The jury also recommended a sentence of life without the possibility of parole for McMurtrey. District Judge John Garrett will formally sentence Roger McMurtrey on Aug. 18. Evidence presented during the three-day trial indicated that McMurtrey used a carpenter's level, grubbing hoe and spade to kill his mother at her Chalk Bluff home east of Stilwell. The attack began in the kitchen with McMurtrey chasing his mother through the house and outside until he caught her, according to evidence presented at trial. ''He took her face off,'' sexually molested her and cannibalized her, prosecutor Darrell Dowty said. McMurtrey allegedly was angry at his mother because she wanted to admit him to Eastern State Hospital in Vinita for a fifth time. Defense attorney Scott Hickman argued that his client should be found innocent by reason of insanity. Hickman pointed to McMurtrey's eight-year history of mental illness and testimony of several witnesses who said they saw him acting strange, drinking furniture cleaner and snorting detergent in the days before his mother's death. Defense witness John R. Smith, a psychiatrist from Oklahoma City, said Wednesday that it was his opinion that McMurtrey did not know right from wrong when he suddenly attacked his mother. Smith said McMurtrey is classified as a paranoid schizophrenic. ''He heard voices that said 'kill her, kill her,' '' Smith testified. ''There's not the slightest doubt in my mind that it was a result of an acute upsurge of illusions (in McMurtrey's mind) that led to her death.'' In fact, Dowty countered, McMurtrey was mentally competent enough at the crime scene to call police and an ambulance and tell authorities exactly how he had killed his mother. He told deputies many details of the attack but did not tell them about voices telling him to kill his mother, the prosecutor pointed out. ''He doesn't mention 'voices' to anyone until several days later . . . at Eastern State Hospital,'' Dowty said. Hickman closed his case by noting that McMurtrey had no history of violence against anyone in his family. Earlier in the trial, A.J.
